INTELLECTUAL PROPERTY Litigation Experience

In 2009, I founded Klemchuk PLLC, a full-service intellectual property boutique. My practice includes a wide range of intellectual property matters (IP), technology law, Internet and e-commerce law, social media, commercial and business litigation as well as general corporate and IP counseling. Through over 26 years of experience as an IP trial attorney, I have handled over 1,000 intellectual property disputes. I advise clients ranging from start ups and solo inventors to large companies. I focus my practice on mid-market companies in the $5M - $500M range. My IP litigation experience includes enforcing patents and defending companies involved in patent litigation in a variety of industries and technologies including semiconductors, Internet, software, ink technology, water pumping systems, and roofing systems. I also have extensive experience with trademark, copyright, trade secret, misappropriation, and other IP cases.

My skills and experience provide four unique benefits to parties wishing to resolve a dispute and avoid the expense of litigation. First, unlike many other mediators, I exclusively mediate intellectual property disputes. This allows the parties to benefit from over 26 years of IP litigation and trial experience. Second, my litigation practice has been evenly balanced between IP enforcement and defense work, which demonstrates I don’t have a bias towards plaintiff’s or defense work. Third, I have founded three multi-million dollar businesses as an entrepreneur. My success has largely been based on exemplary problem solving skills, the ability to empathize with others, and collaborate toward a common goal — all of which I bring as a mediator to help the parties resolve their dispute.
